Acceptance of these terms
These Terms & Conditions ("Terms") govern your access to and use of 9otify.com (the "Website"), operated by 9otify Technologies ("9otify", "we", "us" or "our"), a company based in Noida, Uttar Pradesh, India.
By using the Website you agree to these Terms. If you are using it on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation. If you do not agree, please do not use the Website.
About the Website and our services
The Website gives general information about 9otify and our CPaaS messaging, Information Security and AI services, and lets you send us an enquiry.
Our services are provided only under a separate written agreement between 9otify and the customer, which may include a service description, service-level agreement, acceptable-use policy and data-processing terms. If anything in these Terms conflicts with such an agreement, the agreement prevails for the services it covers.
Nothing on the Website is an offer capable of acceptance. Submitting an enquiry does not create a contract or oblige either of us to enter into one.
Accuracy of information
We work to keep the Website accurate and up to date, but its content is provided for general information only. Statistics, benchmarks and figures shown on the Website — including coverage, delivery times, uptime and AI performance metrics — describe our services in general terms and are not guarantees. Specific commitments apply only where they are written into a signed agreement.
We may change, suspend or withdraw any part of the Website, or any service description on it, at any time without notice.
Acceptable use
You may use the Website only for lawful purposes and in line with these Terms. You must not:
- use the Website in any way that breaks an applicable law or regulation, or for any fraudulent or harmful purpose;
- attempt to gain unauthorised access to the Website, the server it is stored on, or any connected system or data;
- introduce viruses, malware or other harmful code, or carry out a denial-of-service or similar attack;
- use automated tools to scrape, copy or monitor the Website in a way that places an unreasonable load on it;
- submit false, misleading or impersonating information, spam, or unsolicited promotional material through the enquiry form; or
- copy, frame or mirror the Website, or remove or alter any copyright, trademark or other notice on it.
We may suspend or block access to the Website for anyone we reasonably believe is breaching these Terms.
Intellectual property
The Website and its content — including text, graphics, logos, icons, interactive demonstrations and software — are owned by or licensed to 9otify and are protected by copyright, trademark and other intellectual property laws. “9otify”, the 9otify logo and “Intelligence in Motion” are trademarks of 9otify Technologies.
We grant you a limited, non-exclusive, non-transferable and revocable licence to view the Website and print or download pages for your own internal business reference. Any other use — including reproducing, modifying, distributing or commercially exploiting the content — requires our prior written permission.
Enquiries and communications
When you submit an enquiry, you confirm that the information you provide is accurate and that you are entitled to share it. We will use it as described in our Privacy Policy.
Emails and messages exchanged before a written agreement is signed are not binding on either party unless they expressly say otherwise.
Regulatory requirements for messaging
Commercial messaging in India is regulated by the Telecom Regulatory Authority of India, including the Telecom Commercial Communications Customer Preference Regulations, 2018 and the Distributed Ledger Technology (DLT) registration framework. Customers of our CPaaS services are responsible for obtaining recipient consent, registering headers and templates, and complying with these and any other laws that apply to the messages they send. The detailed obligations are set out in our customer agreements.
Third-party links and services
The Website contains links to third-party websites, including our social-media profiles, and relies on third-party services such as FormSubmit to deliver enquiries and Google Fonts to display text. We do not control and are not responsible for third-party websites or services, their content, or their availability. Your use of them is governed by their own terms.
Disclaimer
To the fullest extent permitted by law, the Website is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Website will be uninterrupted, secure or free from errors or harmful components.
Limitation of liability
To the fullest extent permitted by law, 9otify will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, goodwill or data, arising out of or in connection with your use of, or inability to use, the Website or reliance on its content.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Our liability in connection with our services is governed exclusively by the relevant customer agreement.
Indemnity
You agree to indemnify 9otify against any claims, losses, damages and reasonable costs, including legal fees, arising from your breach of these Terms or your misuse of the Website.
Privacy
Our Privacy Policy explains how we collect and use personal data through the Website. It forms part of these Terms.
Changes to these terms
We may revise these Terms from time to time. The “Last updated” date at the top of this page shows when they were last changed, and the version published here applies each time you use the Website. Please check this page periodically.
Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Website, are governed by the laws of India. Subject to applicable law, the courts at Noida (Gautam Buddh Nagar), Uttar Pradesh have exclusive jurisdiction.
General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right does not waive it. These Terms, together with our Privacy Policy, are the entire agreement between you and 9otify about your use of the Website.
